Industrial Recovery Services, Inc., and its affiliates (collectively, "IRS"), respects the privacy of every party who visits the IRS web site(s) and content pages (collectively, the "IRS Web Site"), participates in auctions, and buys or sells items via the IRS Web Site. This document describes the IRS Privacy Statement with respect to information provided to IRS by bidders, consignors, sellers, buyers and other parties who register on the IRS Web Site (collectively, "Registrants") or by other visitors to the IRS Web Site ("Periodic Visitors") (Periodic Visitors, together with Registrants, "Visitors"). Please note that by visiting or using the IRS Web Site you accept the terms of this Privacy Statement and parties who register on the IRS Web Site agree to the terms and conditions associated with registration. This Privacy Statement may be updated from time to time without notice by IRS and it is the responsibility of Registrants and Visitors to check for any changes or modifications to this Privacy Statement. Visitors to the IRS Web Site should note that this Privacy Statement applies only to the IRS Web Site and not to any other web site(s) nor to any other web site(s) linked to or from the IRS Web Site. Anyone who registers on or uses the IRS Web Site must be at least eighteen (18) years of age. Collected Information
Registrants as part of the registration process need to provide IRS with certain information about themselves, which may include email address, name, address, phone number, or other personal information. This and other information must be provided to IRS for a party to participate in any auction.
For each Registrant that participates in an auction (whether as a bidder, a seller or otherwise), IRS will collect and track certain transaction data and monitor a Registrants activities on the IRS Web Site.
For each party that visits the IRS Web Site, IRS may collect data about such Visitor, including the Visitors internet address, data about how often such a Visitor visits the IRS Web Site, content pages visited by such Visitor, search terms used, and information provided through the use of "cookies." In addition, IRS may store some information in the form of a cookie or other similar file that is automatically downloaded to your computer (in either case, a "Cookie"). If you do not want Cookies sent to or stored on your computers hard drive, most browsers allow you to erase Cookies from your hard drive, prevent them from being stored or trigger a warning before a Cookie is stored. Please refer to your browsers instructions or help area to learn more about these functions. Also, please note that if your browser does not accept Cookies or a warning is triggered before a Cookie is stored, this may limit or block a Visitors use of or access to the IRS Web Site or portions thereof.
Use of Information |
IRS may use information provided by Registrants to conduct auctions and facilitate the transfer of auctioned items. IRS may also use information provided by Visitors to compile statistics or measure the effectiveness of various practices or techniques. IRS may use contact information provided by Registrants to send emails or other notices of auctions or matters which may be of interest to Registrants.
For each Registrant who is a winning bidder in an auction, IRS may provide contact and other information about such Registrant to the seller in such auction. Also, IRS may provide contact information about a seller in an auction to a winning bidder. IRS may also provide through the IRS Web Site certain information about items offered for auction by a seller and certain information about the seller. IRS may provide contact information about a winning bidder and a seller to third party service companies in connection with the shipping and delivery of items. IRS may also provide contact, credit card or payment information to third parties, including credit card companies, to complete a transaction and to third parties for fraud protection and credit risk purposes. IRS makes no representation or warranty regarding (i) any third party or the services or information they provide or (ii) the accuracy or validity of any information provided by Registrant, be he a seller, a bidder, a buyer or otherwise.
Third Parties |
Except as provided herein or as otherwise authorized by a Registrant, IRS shall not (i) disclose or sell any Registrant information, including information regarding non-winning bidders at an auction, to a third party, (ii) contact a non-winning bidder in an auction to, among other things, solicit another bid for any item at such auction after a winner has been declared, or contact other bidders if the winning bidder is in default of their legal obligations under the pre-agreed payment terms as well as any other terms and conditions, or (iii) contact bidders to facilitate the sale of an item at auction or otherwise that does not meet the reserve price set for such item (bidders may, nonetheless, contact IRS regarding the purchase of items at auction that do not meet their established reserve). However, IRS may release aggregate or statistical information about Visitors to third parties, but in such case(s), IRS will not release information that identifies a Registrant or Visitor by name. IRS will release Visitor information in accordance with legal proceedings or when IRS believes, in its determination, that such release is warranted to cooperate with law enforcement agencies. Further, IRS may release Visitor information to attorneys, accountants, credit bureaus, collection agencies or consultants if IRS, in its determination, deems such release appropriate. Registrants should know that this Privacy Statement is meant, in part, to prevent Registrants from being bombarded with emails and notices from third parties on account of the information provided to IRS. Thus, IRS has placed the aforementioned protections upon Registrant information.
Information Security |
IRS uses standard security systems to maintain the confidentiality of Visitor information and to prevent third parties from having unauthorized access to such information. Nonetheless, IRS cannot guarantee that Visitor information will not be intercepted by a third party or that a third party will use means to gain unauthorized access to such information.
Opting-Out |
IRS provides Registrants with the option of opting out of receiving emails or other notices from IRS. A Registrant may use the opt-out feature by replying to an email with the single word "Remove" in the subject heading.
